REFUND & RETURNS POLICY

This Refund & Returns Policy applies to purchases made through the BLACKWARD online store.

This policy does not affect any mandatory consumer rights granted under the laws applicable in the customer's country or territory. Where mandatory consumer protection laws provide additional rights that cannot legally be excluded or restricted, those laws shall prevail over any conflicting provision of this policy.

1. RETURNS WITHIN THE EUROPEAN UNION AND EEA

Consumers located in the European Union and European Economic Area generally have a statutory 14-day right of withdrawal from distance purchases without having to provide a reason.

The withdrawal period generally begins on the day on which the customer, or a third party designated by the customer other than the carrier, physically receives the goods.

Where goods from the same order are delivered separately, the withdrawal period begins when the final item is received.

To exercise the right of withdrawal, the customer must clearly inform BLACKWARD of their decision within the applicable legal period by contacting:

The customer should provide their order number and sufficient information for us to identify the purchase.

Where required by applicable European law, customers may also exercise their right of withdrawal using the electronic withdrawal function made available through our online store, customer account or order interface.

Once the customer has communicated their decision to withdraw, the goods must be returned without undue delay and, in any event, no later than 14 calendar days after notifying us of the withdrawal.

The customer is responsible for the direct cost of returning the goods, unless the return results from an error by BLACKWARD, defective goods, incorrect goods, or where applicable law requires us to bear such costs.

BLACKWARD does not accept cash-on-delivery returns or shipments that generate additional charges that have not been previously authorized.

2. CONDITION OF RETURNED PRODUCTS

Customers may handle and inspect products only to the extent reasonably necessary to establish their nature, characteristics, fit and functioning, in a manner comparable to what would normally be permitted in a physical store.

The customer may be held responsible for any reduction in value resulting from handling the product beyond what is reasonably necessary for such inspection.

BLACKWARD may therefore reduce the amount of any refund, where legally permitted and proportionate, if the returned product shows signs of use beyond a reasonable fitting or inspection, stains, dirt, makeup, deodorant, perfume or odors, customer-caused damage, washing or alteration, excessive wear or handling, or missing or damaged tags, packaging or accessories where this has objectively reduced the value of the product.

Any reduction in refund value will be assessed individually and in accordance with applicable law.

Removal of a tag does not automatically eliminate a statutory right of withdrawal where such a right exists, but any resulting reduction in the product's value may be taken into account where legally permitted.

3. REFUNDS AND SHIPPING COSTS IN THE EU/EEA

Where a valid statutory withdrawal applies, BLACKWARD will refund the amounts required under applicable law.

Where original delivery charges must legally be refunded, BLACKWARD will only be required to refund the cost corresponding to the least expensive standard delivery option offered for the order.

Any additional amount paid because the customer selected express, premium, expedited or another more expensive delivery method will not be refunded where applicable law allows this.

The cost of returning the order to BLACKWARD will not be refunded unless the goods were defective, incorrect, or applicable law requires BLACKWARD to bear those costs.

Where legally permitted, BLACKWARD may withhold reimbursement until the returned goods have been received or until the customer provides adequate evidence that the goods have been sent back, whichever occurs first.

Refunds will generally be issued using the same payment method originally used for the purchase, unless otherwise agreed and legally permitted.

4. UNITED KINGDOM

UK consumers generally have the right to cancel eligible distance purchases within 14 days after receiving their goods, without providing a reason.

After notifying BLACKWARD of the cancellation, the customer must return the goods within the time period required by applicable UK law.

Unless the return concerns defective goods, incorrect goods, or another situation in which BLACKWARD is legally required to bear the cost, the customer is responsible for the direct cost of returning the goods.

Where legally permitted, BLACKWARD may make an appropriate deduction from the refund where the value of the goods has been reduced because the customer handled them beyond what is reasonably necessary to inspect them.

Additional delivery costs resulting from the customer's choice of a delivery method more expensive than our least expensive standard option will not be refunded where applicable law permits.

5. UNITED STATES AND REST OF THE WORLD

For orders delivered outside the European Union, European Economic Area and United Kingdom, and except where mandatory local consumer law expressly provides otherwise:

ALL SALES ARE FINAL.

BLACKWARD does not accept returns, exchanges or refunds for change of mind.

This includes, without limitation, situations where the customer:

  • chooses the wrong size;
  • changes their mind;
  • no longer likes the color or style;
  • places an order accidentally;
  • later finds the product at a different price;
  • decides not to use the product;
  • purchases an item on sale.

This restriction does not affect rights relating to defective products, incorrect orders, goods not received, or any other consumer rights that cannot legally be excluded under the law applicable to the customer's purchase.

6. SALE, DISCOUNTED AND FINAL SALE ITEMS

Outside territories where a mandatory legal right of withdrawal or return applies, products marked as:

SALE, FINAL SALE, ARCHIVE, CLEARANCE, OUTLET, or similar wording,

are considered final sale and cannot be returned, exchanged or refunded due to a change of mind.

For consumers in the European Union, EEA or United Kingdom, the fact that an item was discounted or labelled “Final Sale” does not remove any statutory cancellation or consumer rights that cannot legally be excluded.

7. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

Where permitted by applicable law, certain products may be excluded from a statutory right of withdrawal.

These may include:

  • goods made to the consumer's specifications or clearly personalized;
  • sealed goods which are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery;
  • any other products expressly excluded under applicable consumer law.

BLACKWARD will only rely on such exclusions where the legal requirements for the relevant exclusion are satisfied.

A standard item of clothing will not automatically be treated as non-returnable merely by describing it as a hygiene-sensitive product.

8. SIZE OR PRODUCT EXCHANGES

BLACKWARD does not provide a general direct exchange service.

Where a customer is legally entitled to return a product and wishes to receive another size, color or item, the customer should return the original item in accordance with this policy and place a new order, subject to availability.

This does not limit any statutory rights that may apply where an item is defective or does not conform to the contract.

9. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If a customer receives a defective, damaged or incorrect product, they should contact:

The customer should provide their order number and, where reasonably necessary, photographs or video evidence allowing BLACKWARD to assess the issue.

Customers are encouraged to report visible shipping damage as soon as reasonably possible after delivery to facilitate investigation.

This recommendation does not reduce or replace any statutory deadlines or consumer rights.

Where a lack of conformity attributable to BLACKWARD is confirmed, the customer will be entitled to the remedy required by applicable law, which may include:

  • repair;
  • replacement;
  • price reduction;
  • refund;

depending on the circumstances and applicable legislation.

Where legally required, BLACKWARD will bear the reasonable cost of returning defective or incorrect goods.

10. UNCOLLECTED ORDERS, INCORRECT ADDRESSES AND RETURN-TO-SENDER PACKAGES

Customers are responsible for providing a complete and accurate delivery address and for taking reasonable steps necessary to receive or collect their order.

Where a parcel is returned to BLACKWARD due to circumstances attributable to the customer, including:

  • an incorrect or incomplete address;
  • failure to collect the parcel;
  • inability to complete delivery for reasons attributable to the recipient;

BLACKWARD may deduct from any refund those actual shipping, return or handling costs that may legally be charged to the customer.

This provision does not apply where the failed delivery was the responsibility of BLACKWARD or the carrier in circumstances where the risk legally remains with BLACKWARD.

11. CUSTOMS DUTIES, TAXES AND IMPORT FEES

International orders may be subject to customs duties, import taxes, tariffs, brokerage charges or other customs-related fees.

Amounts paid directly by the customer to customs authorities, carriers or other third parties are not necessarily amounts received by BLACKWARD and, unless applicable law requires otherwise, will not be refunded by BLACKWARD.

Where BLACKWARD directly collects duties, taxes or similar charges, refunds will be processed in accordance with applicable tax and consumer laws.

12. REFUND PROCESSING

Once a valid return has been received and inspected, BLACKWARD will process any refund owed to the customer within the time period required by applicable law.

Once BLACKWARD has issued the refund, the time required for the funds to appear in the customer's account may depend on the:

  • bank;
  • card issuer;
  • payment provider;
  • customer's country.

Such processing time is outside BLACKWARD's control.

13. UNAUTHORIZED RETURNS OR RETURNS SENT TO THE WRONG ADDRESS

Customers must follow the return instructions provided by BLACKWARD.

BLACKWARD is not responsible for items:

  • sent to an incorrect address;
  • lost during a return shipment arranged directly by the customer;
  • sent in a manner that prevents the return from being properly identified;

except to the extent that such responsibility cannot legally be excluded.

Customers are strongly advised to use a tracked shipping method and retain proof of postage.

Packages sent to BLACKWARD without sufficient information to identify the corresponding order may experience delays in processing.

14. MANDATORY CONSUMER RIGHTS

Nothing in this Refund & Returns Policy is intended to exclude, restrict or replace consumer rights that cannot legally be excluded or limited.

If any provision of this policy conflicts with a mandatory consumer protection rule applicable to a particular purchase, the mandatory rule will prevail only to the extent required by law.
