Our online store is powered by Shopify.
For the purposes of applicable data protection laws, BLACKWARD is the controller of the personal information described in this Privacy Policy, except where another party acts as an independent controller as explained below.

Our Store is hosted by Shopify.
Shopify provides the e-commerce infrastructure that allows BLACKWARD to display products, process orders and operate the Store.
In providing these services, Shopify may process information including:

shopping cart activity;

For many core Store services, BLACKWARD acts as controller and Shopify acts as processor or service provider.

Shopify's current Data Processing Addendum expressly states that the merchant acts as controller and Shopify as processor for customer personal data in its core services, while Shopify can act independently as a controller for specified Enhanced Services.
9. SHOPIFY NETWORK INTELLIGENCE AND ENHANCED SERVICES
Where Shopify Network Intelligence is enabled, Shopify may securely use information relating to customers' interactions with BLACKWARD together with information from interactions with Shopify and other Shopify merchants to provide enhanced services.
These services may help BLACKWARD and Shopify:
personalize customer experiences;
understand Store and advertising interactions;
improve products and services;
improve fraud protection;
provide more relevant advertising;
measure advertising performance.
Information may therefore be processed by Shopify and relevant third parties in countries other than the customer's country of residence.
In jurisdictions where consent is required for such advertising or tracking activities, BLACKWARD will request consent before using information for those purposes.
Customers may also have rights to object to or opt out of certain uses of their information.
Where Shopify Network Intelligence is enabled, Shopify expressly requires merchants serving EEA, UK or Swiss customers to obtain consent for relevant advertising processing and to provide a means to withdraw it; certain U.S. customers must also receive an opt-out from sharing or targeted advertising.
Customers may manage certain Shopify-specific privacy choices through the Shopify Privacy Portal.
10. HOW WE SHARE PERSONAL INFORMATION
BLACKWARD may share personal information where reasonably necessary with the following categories of recipients.
Shopify
To host, operate and provide our e-commerce Store.
Payment processors
To authorize, process and secure payments.
Shipping and logistics providers
To deliver orders, manage shipments and resolve delivery issues.
Technology providers
Including hosting, cybersecurity, fraud prevention, email and customer service providers.

11. SALE OR SHARING OF PERSONAL INFORMATION
BLACKWARD does not sell personal information in exchange for money.
However, certain transfers of identifiers, device information or online activity to advertising or analytics platforms may legally qualify as a "sale", "sharing" or use for "targeted advertising" under certain U.S. state privacy laws, even where no money is exchanged.
Where those laws apply, eligible residents may have the right to opt out.
BLACKWARD will provide an appropriate privacy or data-sharing opt-out mechanism where required.
Where legally required, we will also recognize supported opt-out preference signals such as Global Privacy Control (GPC).
California law currently expressly recognizes rights to opt out of the sale or sharing of personal information, including through GPC where applicable.
12. INTERNATIONAL DATA TRANSFERS
BLACKWARD is based in Spain, but service providers used to operate the Store may be located in other countries.
Consequently, personal information may be processed outside the customer's country of residence.
Where personal information protected by European or UK data protection law is transferred internationally, appropriate safeguards will be used where required, including, depending on the circumstances:

Shopify states that customer data from the EEA, UK and Switzerland is initially processed by Shopify International Limited in Ireland and may subsequently be processed by affiliates and subprocessors. Shopify's updated Binding Corporate Rules took effect in July 2026 and form part of its framework for international transfers.
13. DATA RETENTION
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including:
fulfilling orders;

meeting tax and accounting obligations;

Order, transaction and accounting information may be retained for the periods required under Spanish law.
Spanish commercial law generally requires businesses to retain business books, correspondence, documentation and supporting records for six years, although particular legal or tax obligations may require different periods.
Marketing information may generally be retained until consent is withdrawn, the customer opts out or the information is no longer necessary for the relevant purpose, subject to applicable law.
Where information is no longer required, it may be deleted, anonymized or otherwise securely disposed of.

BLACKWARD's Store is not directed toward children under the age of 16.
